Who is protected

Federal law. The Fair Housing Act prohibits discrimination in the sale and rental of housing, and in the services that go with it, because of race, color, religion, sex, disability, familial status or national origin.

Florida law. The Florida Fair Housing Act protects the same characteristics. Its protection for familial status also covers anyone who is pregnant or in the process of securing legal custody of a child under 18.

County law. Where we do most of our work, county law goes further.

  • Miami-Dade County also protects ancestry, age, pregnancy, marital status, gender identity, gender expression, sexual orientation, source of income, and actual or perceived status as a victim of domestic violence, dating violence or stalking.
  • Broward County also protects age, marital status, political affiliation, pregnancy, sexual orientation, gender identity or expression, veteran or service member status, lawful source of income, and status as a victim of dating violence, domestic violence, stalking or human trafficking.

Many cities have their own fair housing ordinances too. Wherever the laws differ, we follow the one that protects more people.

The REALTOR® Code of Ethics. Every Newmar licensee is a REALTOR®, a member of the Miami Association of REALTORS® + RWorld, and bound by the National Association of REALTORS® Code of Ethics. Its Article 10 says REALTORS® shall not deny equal professional services to any person for reasons of race, color, religion, sex, disability, familial status, national origin, sexual orientation or gender identity, and shall not be parties to any plan or agreement to discriminate.

What that means when you work with us

  • Every client sees every property that fits what they ask for. We don’t steer anyone toward or away from a neighborhood, building or community because of who they are, and we don’t describe a neighborhood by the people who live there.
  • Our advertising describes the property, never the kind of buyer or tenant wanted.
  • We decline any instruction from a seller, landlord or anyone else that would break these laws, and we will end the engagement rather than follow it.
  • We screen and present offers and applications on their merits, applying the same standards to everyone.
  • If you have a disability and need an accommodation in how we work with you (a different way to communicate, a different meeting place, more time, or help with a request to a landlord or association for an accommodation or an assistance animal), tell us and we will work it out with you.
